      CNES:  Minor (edit.): The last sentence of the 3rd paragraph 
should read : "...CCSDS Management Council  may make a 
standardization decision based on priorities and needs of the larger 
community of CCSDS agencies and ISO member bodies." instead of 
:"CCSDS Management Council  may make a standardization decision based 
on priorities and needs of the larger community of CMC agencies and 
ISO member bodies."
      NASA:  One important statement that was in our first resolution 
has accidentally been left out of this policy.  To correct this, add 
this sentence to the end of the next-to-last paragraph:  CCSDS 
documents that have known patent issues will not be approved for 
publication until an ISO Patent Statement and Licensing Declaration 
Form is signed by the Patent Holder (or pre-existing in the ISO 
Patent Database).

      INPE:  Be it in the Annex and or in its Introduction, if CCSDS 
membership exists from the part of the actual (application) User of 
the patent related CCSDS Standards Track document, consideration 
should be clearly provided by the document of any, if any, 
facilitating privilege that the CCSDS Member may have in this case, 
by also including a comprehensive road map of the procedure to be 
followed by the CCSDS Member for being in compliance to the 
associated privilege.

policy and terminology

Results of CMC poll beginning 20 February 2011 and ending 6 March 2011:

      CNES:  It should be clarified at which stage of the production 
process the patent statement and licensing declaration form should be 
completed. The wording "before any CCSDS document can be submitted to 
the CMC for potential approval on the Standards Track" potentially 
places this requirement quite late and possibly just before CMC 
approval. It was CNES understanding that this should be handled much 
earlier or even at the time of chartering a working group or adding a 
new project/document to a WG charter. Alternately it could be one of 
the first objectives of a just created WG or Project. The background 
idea is not to spend resources and discover difficulties at a late stage.
      INPE:  The comments which are being made by CNES in this poll 
are endorsed. With the addtional consideration: When a patent 
related, new Project is added to the Charter of a CCSDS WG, care must 
also be taken to consider and define the corresponding patent related 
implication in ISO domain. This, in a way that, when the CCSDS 
originated document eventually migrates for due consideration by the 
ISO TC20/SC13 Subcomittee, if any, no further patent related 
discussion is required and, if required, that any patent related 
action to be taken in the ISO domain, may have already been clearly 
defined, by anticipation. This is also of particular importance in 
view of the current practice which uses some degree of concurrency in 
document processing between CCSDS (final stage of a Red Book) and ISO 
TC20/SC13 ("final" Red Book insertion in the ISO DIS-FDIS staging 
tracks) track stages. Summing it up: the earliest a document patent 
related issue is considered and solved, the better for the full track 
of CCSDS and ISO associated stages of processing. Therefore, 
consideration and clearly pre-defined actions may also have to be 
taken by placing in "hold" state the development and or flowing  of a 
CCSDS and or ISO TC20/SC13 document, should such an action turn out 
to be necessary, under justifiably imperative circumstances.
      JAXA:  We note one comment regarding at which stage of the 
production process the patent statement and licensing declaration 
form should be completed,
and are planning to follow this comment at the CCSDS telecon on this subject.
